Klauzula informacyjna

1. Administrator danych osobowych.

Administratorem danych osobowych w rozumieniu Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 UE z dnia 27 kwietnia 2016 r. (dalej: „RODO”) jest GRZEGORZ JĘDRYCH MATERIALIS z siedzibą we Wrocławiu (51-416) przy ul. Kwidzyńska 4E (dalej: „Materialis”), NIP: 7162591590, REGON: 021174206. Z administratorem danych można się skontaktować poprzez adres email biuro@materialis.pl lub telefonicznie pod numerem +48 71 307 30 94 lub +48 503 019 187 lub pisemnie na adres siedziby Administratora.

2. Cel i podstawy przetwarzania.

Dane osobowe będą przetwarzane przez Administratora w celu:

  1. wymiany korespondencji celem obsługi zapytania dokonanego drogą telefoniczną, e-mailową bądź za pośrednictwem udostępnionego formularza na stronie www.materialis.pl/ibelts_kontakt.php (art. 6 ust. 1 lit b RODO),
  2. przedstawienia oferty produktu, a także zawarcia, wykonania oraz realizacji zobowiązań wynikających z zawartej umowy (art. 6 ust. 1 lit b RODO),
  3. ewentualnego ustalenia, dochodzenia lub obrony przed roszczeniami będących realizacją prawnie uzasadnionego interesu Administratora (art. 6 ust. 1 lit. f RODO) lub niezbędności przetwarzania do wykonania umowy (art. 6 ust. 1 lit. b RODO),
  4. archiwalnym (dowodowym) będących realizacją prawnie uzasadnionego interesu zabezpieczenia informacji przez Administratora na wypadek prawnej potrzeby wykazania faktów (art. 6 ust. 1 lit. f RODO),
  5. wykonania obowiązków wynikających z przepisów prawa, w tym przepisów prawa podatkowego, przepisów o rachunkowości w związku z obowiązkiem wynikającym z ustawy z dnia 29 września 1994 roku o rachunkowości polegającym na konieczności przechowywania dowodów księgowych (art. 6 ust. 1 lit. c RODO),
  6. w celu marketingu własnych produktów i usług Materialis (art. 6 ust. 1 lit. f RODO), gdzie prawnie uzasadnionym interesem jest marketing bezpośredni, z zastrzeżeniem, że przesyłanie informacji handlowej za pomocą środków komunikacji elektronicznej w celach marketingowych jest możliwe tylko za wyrażoną zgodą,
  7. w innych celach, na które została wyrażona zgoda (art. 6 ust. 1 lit. a RODO). Udzielenie zgody w takich przypadkach jest dobrowolne, choć może być niezbędne do realizacji celu przetwarzania danych.

3. Prawo do sprzeciwu.

  1. w zakresie, w jakim podstawą przetwarzania danych osobowych jest przesłanka prawnie uzasadnionego interesu Administratora, przysługuje prawo wniesienia sprzeciwu wobec przetwarzania danych osobowych. Administrator przestanie przetwarzać dane, chyba że będzie w stanie wykazać, że w stosunku do tych danych istnieją dla Administratora ważne prawnie uzasadnione podstawy, które są nadrzędne wobec interesów, praw i wolności lub dane będą niezbędne Administratorowi do ewentualnego ustalenia, dochodzenia lub obrony roszczeń,
  2. aby wykonać prawo do sprzeciwu, należy skontaktować się z Administratorem i złożyć pisemny wniosek.

4. Okres przechowywania danych.

Dane osobowe będą przechowywane przez okres zależny od celu przetwarzania:

  1. dla celów wykonania czynności wynikających z wymiany korespondencji przez okres jej wymiany oraz dla celów wykonania zobowiązań wynikających z zawartej umowy przez okres trwania umowy, a po ich wygaśnięciu przez okres dochodzenia ewentualnych roszczeń oraz przedawnienia tych roszczeń zgodnie z przepisami ustawy z dnia 23 kwietnia 1964 roku - Kodeks cywilny,
  2. dla celów rachunkowych przez okres konieczny dla przechowywania dowodów księgowych zgodnie z ustawą z dnia 29 września 1994 roku o rachunkowości,
  3. udostępnienia funkcjonalności strony internetowej oraz Serwisu i utrzymania połączenia – na czas trwania połączenia,
  4. marketingu własnych produktów i usług – do czasu wycofania zgody lub do momentu całkowitego realizacji celu przetwarzania danych,
  5. na który została wyrażona zgoda na przetwarzanie danych – do czasu wycofania zgody lub do momentu całkowitej realizacji celu przetwarzania danych,
  6. a także przez czas jaki wynika z wymogów powszechnie obowiązującego prawa.

5. Odbiorcy danych.

Dane mogą być przekazane:

  1. podmiotom uprawnionym do żądania tych danych na podstawie obowiązujących przepisów (na przykład: sądom, organom nadzoru,
  2. podmiotom świadczącym na rzecz Administratora usługi (podmiotom przetwarzającym na podstawie umowy powierzenia przetwarzania danych) np. firmom księgowym, prawniczym, informatycznym,
  3. nabywcom wierzytelności.

6. Odbiorcy danych spoza Unii Europejskiej

Twoje dane nie będą przekazywane odbiorcom spoza Unii Europejskiej.

7. Prawa osób, których dane dotyczą.

  1. dostępu do swoich danych oraz otrzymania ich kopii,
  2. sprostowania (poprawiania) swoich danych,
  3. usunięcia, ograniczenia lub wniesienia sprzeciwu wobec ich przetwarzania (z zastrzeżeniem odmowy usunięcia w przypadku stwierdzenia obowiązku prawnego, któremu podlegamy),
  4. przenoszenia danych,
  5. w zakresie, w jakim podstawą przetwarzania danych osobowych jest zgoda wyrażona na podstawie przepisów RODO – prawo do wycofania takiej zgody. Wycofanie zgody nie ma wpływu na przetwarzanie, którego dokonano przed jej wycofaniem,
  6. wniesienia skargi do organu nadzorczego.

8. Prawo wniesienia skargi do organu nadzorczego

Przysługuje również prawo do wniesienia skargi do organu nadzorczego zajmującego się ochroną danych osobowych w państwie członkowskim zwykłego pobytu, miejsca pracy lub miejsca popełnienia domniemanego naruszenia. W przypadku Polski tym organem jest: Prezes Urzędu Ochrony Danych Osobowych (PUODO) ul. Stawki 2, 00-193 Warszawa, telefon: 22 531 03 00.

9. Informacja o dobrowolności podania danych.

Podanie danych jest dobrowolne, ale konieczne dla celów zawartych w punkcie 2.

10. Zgoda oraz informacja o możliwości wycofania zgody.

W każdej chwili przysługuje prawo do wycofania zgody na przetwarzanie danych osobowych, ale cofnięcie zgody nie wpływa na zgodność z prawem przetwarzania, którego dokonano na podstawie zgody przed jej wycofaniem.

11. Zautomatyzowane przetwarzanie, w tym profilowanie

Dane osobowe nie będą przetwarzane w sposób zautomatyzowany (w tym w formie profilowania), mogący wywoływać skutki prawne lub w podobny sposób istotnie wpływać na sytuację podmiotu udostępniającego dane osobowe.

1. Personal data Controller.

The controller of personal data within the meaning of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter: the “GDPR”) is GRZEGORZ JĘDRYCH MATERIALIS with its registered office in Wrocław (51-416), ul. 2. Purpose of and grounds for processing.

The Controller will process personal data for the following purposes:

  1. exchanging correspondence in order to handle an inquiry submitted by telephone, e-mail or using the contact form available at www.materialis.pl/ibelts_kontakt.php (Article 6 (1) (b) of the GDPR),
  2. presenting a product offer and entering into, performing and settling or realizing obligations resulting from a concluded contract (Article 6 (1) (b) of the GDPR),
  3. establishing, exercising or defending claims that fulfil the legitimate interest of the Controller (Article 6 (1) (f) of the GDPR) or establishing, exercising or defending the claims that processing is necessary for the performance of a contract (Article 6 (1) (b) of the GDPR),
  4. for archiving (evidential) purposes that fulfil the legitimate interest of the Controller to secure information in case of a legal need to prove facts (Article 6 (1) (f) of the GDPR);
  5. for fulfilling obligations required by law, including tax law, accounting regulations in conjunction with obligation resulting from Accounting Act of 29th September, 1994, requiring the retention of accounting documents (Article 6 (1) (c) of the GDPR).
  6. for marketing goods and services offered by Materialis (Article 6 (1) (f) of the GDPR), where direct marketing is the legitimate interest, provided that sending marketing information via electronic means of communication is possible only with consent,
  7. for other purposes for which consent was given (Article 6 (1) (a) of the GDPR). giving consent in such cases is voluntary, however it may be necessary in order to process the data.

3. The right to object.

  1. To the extent that your personal data is processed on the basis of a legitimate interest of the Controller, your have the right to object to the processing of your personal data. The Controller will cease to process such data unless the Controller is able to prove that it has significant legitimate grounds for processing that override your interests, rights and freedoms, or the Controller needs the data to establish, exercise or defend claims;
  2. in order to exercise the right to object, please contact the Controller and submit a written request.

4. Data retention period.

The Controller will store personal data for a period depending on purpose of processing:

  1. for purposes of carrying out actions resulting from exchange of correspondence for the duration of such exchange and for purposes of performing obligations resulting from a concluded contract for the term of such contract and after their expiration for the period of pursuing possible claims and during a period of limitations regarding such claims, in accordance with previsions of the Civil Code of 23rd April 1964,
  2. for accounting purposes for a period necessary for retaining accounting documents in accordance with Accounting Act of 29th September, 1994,
  3. for sharing the website and Internet Service features and maintaining the connection - for the duration of the connection,
  4. for marketing own goods and services – until withdrawal of consent or until the purpose of data processing is completed in full,
  5. for purposes for which a consent was given for data processing – until such consent is withdrawn or until the purpose of data processing is completed in full,
  6. as well as for a period required by generally applicable law.

5. Data recipients.

The data may be shared with:

  1. entities authorized to request such data on the basis of applicable regulations (i.e. courts of law, supervisory bodies),
  2. entities providing services o the Controller (entities that process data under personal data processing outsourcing agreement), i.e. Accounting, legal, IT companies,
  3. purchasers of debts.

6. Data recipients from outside the European Union

Your data will not be transferred to recipients from outside the European Union.

7. Rights of data subjects.

Under the GDPR, you have the following rights:

  1. the right to access your data and receive a copy of your data,
  2. the right to rectify (correct) your data,
  3. the right to erase your data, restrict their processing or object to the processing of data (subject to refusal to erase the data due to a legal obligation imposed on us),
  4. the right to data portability,
  5. to the extent in which data is processed with consent given under provisions of GDPR – the right to withdraw such consent. Withdrawal of consent has no effect on processing carried out prior to such withdrawal.
  6. the right to file a complaint with the supervisory authority.

8. Right to file a complaint with supervisory authority

Data subjects also have the right to file a complaint to data protection supervisory authority in a Member State of habitual residence, of work or of Member State where the alleged infringement took place. In case of Poland this supervisory authority is: President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych – PUODO) ul. Stawki 2, 00-193 Warsaw, phone: 22 531 03 00.

9. Information on voluntariness of providing personal data.

Providing the personal data is voluntary, but it is necessary for purposes included in item 2.

10. Consent and withdrawal of consent.

You may withdraw your consent to the processing of personal data at any time. However, the withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

11. Automated processing, including profiling

Personal data will not be processed in automated manner (including in the form of profiling) that might cause legal effects or in manner similarly significantly affecting the situation of the person providing the personal data.
